We offer you an online purchasing service which allows you to buy a selection of alcoholic, non-alcoholic drinks and glassware accessories. The Webshop is operated by Nick’s Bottle Shop Ltd (hereinafter referred to as “Company” or “We”).
These General Terms and Conditions (“GTC”) governs the conditions of use of this Website and your purchase of products available on this Website’s Online Store (“Webshop”).
We may modify at any time these GTC non-retrospectively. The modification shall take effect upon publication on this Website and shall apply to transactions taking place thereafter.
Please consider, only those persons may purchase on the Website who are at least 18 years old and are of legal capacity. Furthermore, the Website is intended for use by you only if you are of legal purchase age to purchase alcohol in your country of residence and in the country from which you are accessing the Website. If you do not fall within this category, you may be in breach of laws or regulations applicable in your country of residence or in your country of access and you must leave the Website immediately.

3) PRODUCTS
This Webshop offers for sale alcoholic, non-alcoholic drinks and glassware accessories (“Products”).
The Products can be found either under the categories, such as whisky, gin, rum, vodka, wines, champagne, glassware – accessories etc., or by direct search. Furthermore, it is possible to search for product names and keywords.
4) REGISTRATION
Purchases may be initiated by registered users. The Webshop can also accept orders/purchases without registration from Guest users. Without a registered account, Guest users every time must fill in the order form with their personal details. Also, during checkout all users are given the chance to either login to an existing account or create an account if they wish to do so.
Your account may be created by filling the registration form under the “Log in” menu item available on the main page. By registering on the Website, you declare to have gained knowledge of the present GTC, any separate Terms and our Privacy Policy. The registration shall be identified by the e-mail address, i.e. each e-mail address may be registered only once. The registration shall not create any obligation. Purchases on the Website may be effected by placing orders electronically.
Products can be delivered domestically and internationally. We shall perform orders which have been received from Cyprus, and also outside Cyprus such as from the member states of the European Union and from other European countries (like United Kingdom, Switzerland, Norway).
It is possible to subscribe to direct marketing messages (Newsletter) on a voluntary basis.
Should you have registered on the occasion of any earlier purchase in the Webshop, you may log in by using your e-mail address and password, so you will be able to continue shopping with your personal data disclosed earlier.
The Company disclaims its liability for cases where you make use of its services by disclosing false data or data relating to another person.
5) PURCHASE PROCEDURE
You can access your cart by clicking on ‘Cart’ icon on the top right corner of any page of the Website. Here you can see and check the products that you have already selected and wish to purchase. You can set the quantity of a product on the Cart page.
Select the products you wish to purchase and add them to the shopping cart, by clicking on the corresponding icon. This must be repeated for every product you wish to purchase.
To proceed with the purchase, your personal data will be required and will be included in our database in order to process the order and simplify future purchases. The personal data provided by you shall be treated in accordance with our Privacy Policy.
Once the order has been completed, and before the order is confirmed, you will be provided with a summary of the order, identifying the item(s) purchased, the total price (including transport and taxes) and the order delivery details, in order for you to confirm this by clicking on the ‘Confirm payment’ button. In case you detect any error before the order is confirmed, you can edit the provided details by clicking on the “edit” or “delete” buttons. In case you detect any error in your order once the purchase is completed, please contact us.
Orders are subject to confirmation and availability. The products in your cart are not reserved; they may be purchased by other Users before the finalisation of your order (full completion of the ordering process) and your confirmation.
An automated order confirmation e-mail will be sent to the email address indicated by you within 30 minutes as of placing of the order with acknowledgement of receipt, a description of the order and the personal details you provided. If you do not receive this e-mail, this could be due to a temporary communications problem in the network or an error in the e-mail address entered. In both cases, we advise you to contact us. Similarly, an e-mail will be sent to you confirming that the product has been dispatched.

You may use the Website at his/her own risk only and agrees that the Company shall not be liable for any material and non-material damages arising during the use of the Website or for any problems caused intentionally or as a result of gross negligence or crime.
We shall not be liable at all for any damage or mistake arising from the alteration of the registered data by you.

8) CONCLUSION OF CONTRACT
Placing an order shall be deemed conclusion of a contract by electronic. Any electronic contract concluded based on these GTC between us and you by placing of your order shall not be construed as a written contract; hence it shall not be filed and cannot be later accessed on paper. The conclusion of the contract shall be verified by the purchase data saved electronically.
On the Website, there may be links pointing to websites of third company. The Company shall be responsible neither for the data protection practice, nor for any other activity of such companies.
9) RIGHT OF WITHDRAWAL
We hereby inform you that the right of withdrawal under Consumer Protection Law of 2021 (Law. 112(I)/ 2021) on the rules of contracts concluded between consumers and business operations shall be granted only to customers who qualify as consumers. Pursuant to the law “consumer” shall mean any natural person acting for purposes which are outside his trade, business or profession; any natural person who purchases, orders, receives, uses or makes use of goods; as well as any natural person who is the recipient of any commercial communication or offer relating to goods (hereinafter referred to as “consumer”).
In accordance with the Directive 2011/83/EU of the European Parliament and of the Council, as well as with the Cyprus legislation referred above, consumers shall be entitled to withdraw from the contract without giving any reason, within 14 (fourteen) calendar days counted from receiving the product either personally or by a third person other than the carrier and designated by you; furthermore, in case several products are delivered, from the receipt of the product that was delivered as the last one.
You as Consumer shall be entitled to exercise your right of withdrawal during the period between the conclusion of the contract and the date of receipt of the product.
You may exercise your right of withdrawal in a manner that you shall send an unequivocal statement on your intention of withdrawal using our contact details. We propose that you send your letter by registered mail so that the date of posting can be credibly certified.
We shall acknowledge by e-mail the receipt of your notification on withdrawal. In case of withdrawal, you shall return the ordered product to the address specified in this GTC without undue delay but not later than within 14 days of notification of the statement of withdrawal. The deadline is met if the product is sent (posted or handed over to a courier) by you before the end of the 14-day deadline.
10) FORFEITURE OF THE RIGHT OF WITHDRAWAL
The right of withdrawal shall not be granted to you in the following cases:
- If you have opened, consumed, used, altered the product, or have caused any damage to it.
- If the identification label has been removed from the product.
- If you fail to send back the products completely, unopened, unused; furthermore, if you fail to send back a set of products with all parts, if any.
11) VERIFICATION OF RIGHT OF WITHDRAWAL
After returning the goods, we shall verify whether you are entitled to return the goods. If the return meets all conditions, you are notified of the acceptance of the returned goods by e-mail and we shall replace the products or repay the purchase price of the returned products based on the choice of you.
The time frame of reimbursement depends on the type of payment used.
12) WARRANTY, COMPLAINT HANDLING
You may enforce your warranty or consumer complaints related to the product or the activity of our Company using the contact details.
We shall provide substantive reply to complaints made in writing within 30 days.
You as consumer may lodge a complaint with the competent consumer protection authority.
13) TECHNICAL LIMITATIONS
We make every effort to ensure that the information contained on this Website is complete, accurate and correct. In the event of any error, inaccurate or incomplete data we shall proceed to correct it immediately.

This Website originates from Cyprus. These GTC and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of Cyprus and any disputes will be decided only by the Cyprus courts.
